Online Shop Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the online shop (hereinafter referred to as the "Service") provided by the Tsumami Zaiki Association (hereinafter referred to as the "Association") on this website. All registered users (hereinafter referred to as "Users") must use the Service in accordance with these Terms.


Article 1 (Applicability)

  1. These Terms shall apply to all relationships between the User and the Association regarding the use of the Service.

  2. In addition to these Terms, the Association may establish various rules or regulations (hereinafter referred to as "Individual Provisions"). Regardless of their names, these Individual Provisions shall form part of these Terms.

  3. If any provision of these Terms conflicts with the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

Article 2 (User Registration)

  1. Registration is completed when an applicant agrees to these Terms, applies for registration via the method specified by the Association, and the Association notifies the applicant of its approval.

  2. The Association may decline an application for registration if it determines that the applicant meets any of the following criteria, and the Association is under no obligation to disclose the reason:

    • Providing false information during application.

    • The applicant has previously violated these Terms.

    • Any other reason the Association deems the registration inappropriate.

Article 3 (User ID and Password Management)

  1. Users are responsible for managing their own User ID and password for this Service.

  2. Users may not transfer, lend, or share their User ID and password with any third party. If a login occurs with a matching ID and password, the Association will treat it as use by the registered User.

  3. The Association shall not be liable for any damage caused by the use of an ID or password by a third party, except in cases of intentional misconduct or gross negligence by the Association.

Article 4 (Purchase Agreement)

  1. A sales contract is established when a User submits a purchase order and the Association sends a notification of acceptance. Ownership of the product transfers to the User when the Association hands the product to the delivery carrier.

  2. The Association may terminate the sales contract without prior notice if the User:

    • Violates these Terms.

    • Cannot be reached for delivery due to an unknown address or prolonged absence.

    • Is deemed to have damaged the relationship of trust with the Association.

  3. Payment methods, shipping, cancellations, and returns are governed by the methods separately specified by the Association.

Article 5 (Intellectual Property Rights)

Copyrights and other intellectual property rights for product photos and other content provided through the Service belong to the Association or the respective right holders. Unauthorized reproduction, republication, modification, or any secondary use is prohibited.

Article 6 (Prohibited Actions)

Users must not engage in the following:

  • Violating laws or public order and morals.

  • Actions related to criminal activity.

  • Infringing on copyrights, trademarks, or other intellectual property rights of the Service.

  • Damaging or interfering with the Association’s servers or networks.

  • Commercial use of information obtained through the Service.

  • Interfering with the operation of the Service.

  • Unauthorized access or attempting such access.

  • Collecting personal information of other Users.

  • Impersonating another User.

  • Providing benefits directly or indirectly to anti-social forces.

  • Any other actions deemed inappropriate by the Association.

Article 7 (Suspension of Service)

  1. The Association may suspend or interrupt the Service without notice if:

    • Performing maintenance or updates on the computer system.

    • Service becomes difficult due to force majeure (earthquakes, lightning, fire, power outages, natural disasters, etc.).

    • Accidental shutdown of computers or communication lines.

    • The Association otherwise deems providing the Service to be difficult.

  2. The Association shall not be liable for any disadvantage or damage suffered by Users or third parties due to such suspension.

Article 8 (Restriction of Use and De-registration)

The Association may restrict a User’s access or delete their registration without prior notice if the User violates any part of these Terms, provides false information, fails to pay fees, or if the Association deems use of the Service inappropriate.

Article 9 (Withdrawal)

Users may withdraw from the Service by following the prescribed withdrawal procedures.

Article 10 (Disclaimer of Warranty and Limitation of Liability)

  1. The Association does not guarantee that the Service is free from defects (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security-related bugs/errors).

  2. The Association is not liable for any damage caused to Users by the Service, except as required by the Consumer Contract Act.

Article 11 (Changes to Service Content)

The Association may change or discontinue the Service without notice and is not liable for any resulting damage.

Article 12 (Modification of Terms)

The Association may modify these Terms at any time without notice. Continued use of the Service after changes constitutes agreement to the new Terms.

Article 13 (Handling of Personal Information)

Personal information obtained through the Service will be handled appropriately in accordance with the Association's "Privacy Policy."

Article 14 (Notification or Contact)

Notifications between the User and the Association shall be conducted via the methods specified by the Association.

Article 15 (Prohibition of Assignment of Rights and Obligations)

Users may not transfer or pledge their status or rights/obligations under these Terms to a third party without prior written consent from the Association.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.

  2. Any disputes regarding the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Association’s head office.
